Dave Meltzer mentioned on the most recent episode of Wrestling Observer Radio that Batista is apparently still under contract with WWE.

Eventhough “The Animal” is still signed to a deal, it doesn’t mean that he will be used any time in the near future. Batista is focused on his film career, which includes landing a role in the next James Bond movie, Spectre.
