A report from NJ.com says the lawyer for the truck driver, Kevin Roper, who allegedly caused the New Jersey Turnpike crash that injured Tracy Morgan and injured one of his friends is accusing Morgan’s lawyer of interfering with his client’s right to a fair trial. Glassman appears to want the Morgan’s civil lawsuit for the case to be delayed until Roper’s criminal case is resolved.
Roper’s attorney, David Glassman, reportedly filed legal documents on Wednesday (Dec. 11) in US District Court that say Morgan’s lawyer, Benedict Morelli, has made damaging comments to the media with regards to Roper in order to get a big-money settlement from Wal-Mart. Wal-Mart is the owner of the truck driven by Roper for the crash that took place on June 7, 2014. Morgan is currently embroiled in a civil case against Wal-Mart over the crash, claiming that Wal-Mart was at fault for Roper being sleep deprived at the time of the crash.
In addition, Glassman is reportedly seeking to delay discovery, or pre-trial sharing of documents, for Morgan’s civil case against Wal-Mart until Roper’s current criminal case is resolved. Roper is currently facing charges of death and assault by auto. He has pleaded not guilty to those charges.
Glassman claims that is the discover goes on now, Middlesex County prosecutors could take evidence that could be used against Roper in the criminal proceedings.
