Hmmm, I guess keep doing what your doing then, although I've never seen someone get penalized when it comes to thumbnails, most of the popular lp'ers (Pretty much all of them actually) use images from the game. Maybe it depends on the company, I know I saw a list one day of all the companies who allow people to freely use there game on YouTube, so maybe they only let you use them in thumbnails.
