TMZ reports that Drake has been accused of theft of a 1982 song, "Jimmy Smith Rap," by jazz musician Jimmy Smith for his track, "Pound Cake/Paris Morton Music 2."

Drake's song reportedly begins with a 35 second monologue from "Jimmy Smith Rap." According to the lawsuit, Drake never obtained permission to use the clip. According to the liner notes of the song, the clip was properly licensed.

Smith is previously deceased, but his estate maintains in the lawsuit that they did not grant permission for the clip, nor did anyone ask for it. The lawsuit is against Drake, Cash Money Records, and some other parties for the amount of $300,000
